The agreement, in plain terms.

1. Agreement to these terms

By downloading, opening, or using Valeska, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the app.

2. Who can use Valeska

You must be at least 18 years old to use Valeska. You may use Valeska to manage your own chronic care, or, as a parent or caregiver, to help manage the care of someone who has allowed you to, or whose care you are legally responsible for, such as your child.

3. What Valeska is

Valeska is a mobile app for tracking chronic illness symptoms, medications, appointments, and questions, and for making Visit Prep summaries to share with your doctor. It is a personal health organizer. It is not a medical device, not a diagnostic tool, and not a substitute for medical advice.

What you log in Valeska is for your own records and to help you talk with your care team. Valeska does not:

• Provide medical diagnoses
• Recommend treatments or therapies
• Check whether doses, schedules, or medications are right for you
• Replace the judgment of your prescriber, pharmacist, or other healthcare provider
• Monitor your health in real time

Always talk to your doctor or another qualified healthcare provider about medical decisions.

4. Drug interaction information

Valeska shows drug interaction information from public government databases (DailyMed and openFDA drug labels). It is for general reference only, and it:

• May not include every known interaction
• May not reflect the most current labeling
• Does not account for your own health conditions, other medications, allergies, or doses
• Is not a substitute for a check by your pharmacist

Talk to your pharmacist or doctor before starting, stopping, or combining any medications.

5. Voice, scans, and on-device AI

Valeska can turn voice input and label scans into entries. Label scanning and AI features run on your phone. Voice input is handled by your phone's speech service, as described in our Privacy Policy. These features:

• Do not send saved health data to an outside AI service. Valeska does not store voice audio or send it to PhoenixCKK.
• Can get things wrong, so always check the result before you save it
• Are convenience tools, not clinical tools. What they produce is not medical advice.

You are responsible for checking and fixing anything these features fill in before it is saved to your records.

6. Your license to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Valeska for your own personal, non-commercial purposes, subject to these terms. We keep all rights not expressly granted to you.

7. No account

Valeska has no account, sign-in, or password. Your records live on your phone. You're responsible for keeping your phone and your recovery code safe, and for keeping your health information accurate. If you lose both your backup key and your recovery code, no one can open your backup, including us, and we can't recover your records.

8. Your data

The health information you enter is yours. It stays on your phone and in any backup or copy you choose to make, as described in our Privacy Policy. We don't receive it and never sell it. You can export it, save a copy, or erase it at any time from Settings.

If you connect Apple Health or Health Connect, that data is used only to show your trends and in Visit Prep summaries you choose to share. It is never sold, shared with advertisers or data brokers, or used for marketing.

9. Free trial and purchase

• Free trial. Valeska is free for 7 days from the first time you open it, with every feature.
• One-time purchase. After the trial, a one-time purchase through the App Store or Google Play unlocks Valeska for good. The purchase is called Valeska Plus. It is $4.99 in the United States. The store shows your price before you buy, and that is the price that applies. There is no subscription.
• After the trial without the purchase. Valeska becomes read-only. You can still view, export, back up, and delete your records. Adding or editing entries asks you to unlock first.
• Had Valeska before? If you used Valeska before the one-time purchase was introduced, you keep full access for good. You don't need to buy anything.
• One store at a time. An App Store purchase unlocks Valeska on your Apple devices. On Android, it is a separate purchase through Google Play. On iPhone and iPad, Family Sharing lets people in your Apple family use the unlock too.
• Payments. Apple processes App Store purchases and Google Play processes Google Play purchases. PhoenixCKK does not receive or store your payment details. Purchases also follow the store's own terms. You can use Restore purchase in the app. On iPhone and iPad you can also use Redeem a code. On Android, you redeem a promo code in the Play Store.
• Refunds. Apple or Google handles refund requests under its own policies. Except where the law requires it, we don't issue refunds directly.

10. Acceptable use

You agree not to:

• Use Valeska to break any law or these terms
• Use Valeska to give medical advice to others
• Rely on Valeska as your only source of medication safety information
• Misrepresent yourself or someone else
• Try to access another person's data without their permission
• Reverse engineer, decompile, or try to extract source code, except where the law allows it
• Interfere with or disrupt the app or its security
• Resell, sublicense, or commercially exploit the app

11. Intellectual property

Valeska, the Valeska name and logo, and the app's design, code, and content are owned by PhoenixCKK LLC and protected by intellectual property laws. You keep ownership of what you enter, such as your symptoms, medications, and notes. These terms don't transfer any ownership of it to us.

12. Outside services and app stores

Valeska relies on services such as Apple (including iCloud, Apple Health, and the App Store), Google (including Google Play and Health Connect), and public reference databases. Your use of those services may be subject to their own terms, and we're not responsible for outside services or their content.

These terms are an agreement between you and PhoenixCKK LLC, not with Apple or Google. Apple has no obligation to provide maintenance or support for Valeska and is not responsible for addressing any claims relating to it. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Use of the Android version is also subject to the Google Play terms that apply to you.

13. Disclaimers

Valeska is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that:

• The app will be error-free, uninterrupted, or secure
• Drug interaction data will be complete, accurate, or current
• Voice or label scan results will be accurate
• Any pattern the app shows is clinically meaningful
• The app will meet your specific health needs
• Data will never be lost, so always keep your own records of important medical information

14. Limitation of liability

To the fullest extent the law allows:

• PhoenixCKK LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of (or inability to use) Valeska.
• We are not liable for health outcomes, medication decisions, or clinical actions taken or not taken based on information in Valeska.
• We are not liable for errors in drug interaction data from government databases, or in voice or label scan results.
• Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $50.

15. Indemnification

You agree to indemnify and hold PhoenixCKK LLC harmless from claims arising out of your misuse of the app, your violation of these terms or of applicable law, or your reliance on information in the app for medical decisions.

16. Termination

You may stop using Valeska and erase your data at any time. We may suspend or end your license if you violate these terms or to protect the app or other people who use it. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will survive.

17. Changes

We may update the app and these terms over time. If we make material changes, we'll update the "Last updated" date and tell you in the app. Continued use after changes take effect means you accept the updated terms.

18. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any legal action must be brought in the state or federal courts located in Brevard County, Florida. Valeska is offered to users across the United States.
