The agreement, in plain terms.
These terms govern your use of Valeska, the chronic-care companion app from PhoenixCKK LLC. Please read them, especially the medical disclaimer.
Important medical disclaimer
Valeska is not a medical device and doesnot provide medical advice, diagnosis, or treatment. It organizes information you enter and surfaces observational patterns, nothing more. Always seek the advice of a qualified health professional with any questions about a medical condition, and never disregard or delay professional medical advice because of something in the app. If you think you may have a medical emergency, call 911 (or your local emergency number) immediately.
1. Agreement to these terms
By downloading, accessing, or using Valeska, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the app.
2. Who can use Valeska
You must be at least 18 years old to create an account. You may use Valeska to manage your own chronic care, or, as a parent or caregiver, to help manage the care of someone who has authorized you to do so, or whose care you are legally responsible for, such as your child.
3. Your license to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Valeska for your own personal, non-commercial purposes, subject to these terms. We keep all rights not expressly granted to you.
4. Your account
You're responsible for keeping your account credentials secure and for activity under your account. Provide accurate information, and let us know promptly if you suspect unauthorized access.
5. Your data
The health information you enter is yours. We handle it as described in our Privacy Policy, local-first, encrypted, never sold. You can export it via visit-prep sharing and delete it, along with your account, at any time from Settings.
6. Subscriptions & billing
- Valeska's core tracking features are free, including logging, reminders, charts, barcode and label scanning, document scanning, and local document storage. Valeska Pro unlocks premium features including cloud sync & backup, caregiver sharing, visit-prep export, and AI-powered insights.
- Valeska Family includes everything in Pro, for you and the dependent profiles you manage.
- Pro and Family are each offered at $3.99/month or $39.99/year. Prices may vary by region and over time, the price shown in the App Store at the time of purchase is what applies.
- People you invite as caregivers do not need a subscription to view what you share with them.
- Purchases are processed by Apple through your Apple ID and are subject to Apple's terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
- Manage or cancel your subscription in your Apple ID settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.
7. Acceptable use
You agree not to:
- Use Valeska for any unlawful purpose or in violation of these terms
- Reverse-engineer, decompile, or attempt to extract source code, except where the law allows it
- Interfere with or disrupt the app, its security, or its infrastructure
- Access another person's data without their authorization
- Resell, sublicense, or commercially exploit the app
8. Intellectual property
Valeska, the Valeska name and logo, and the app's design, code, and content are owned by PhoenixCKK LLC and protected by intellectual- property laws. Your data remains yours; these terms don't transfer any ownership of it to us.
9. Third-party services & Apple
Valeska relies on services such as Apple, Supabase, and public reference databases. Your use of those services may be subject to their own terms, and we're not responsible for third-party services or content.
These terms are an agreement between you and PhoenixCKK LLC, not with Apple. Apple has no obligation to provide maintenance or support for Valeska and is not responsible for addressing any claims relating to it. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Disclaimers
Valeska is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that any pattern it surfaces is clinically meaningful.
11. Limitation of liability
To the fullest extent permitted by law, PhoenixCKK LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of (or inability to use) Valeska. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim, or US $50.
12. Indemnification
You agree to indemnify and hold PhoenixCKK LLC harmless from claims arising out of your misuse of the app or your violation of these terms or of applicable law.
13. Termination
You may stop using Valeska and delete your account at any time. We may suspend or terminate access if you violate these terms or to protect the service or other users. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will survive.
14. Changes
We may update the app and these terms over time. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Valeska is offered to users across the United States.
